Fluyenta provides an observability, AI orchestration, and developer tools platform for Ruby on Rails applications. Our services include logging, error tracking, performance monitoring, feature flags, secrets management, and AI-powered developer tools.

8. Service Availability

We strive to maintain high availability of our Services, but we do not guarantee uninterrupted access. We may:

9. Limitation of Liability

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify and hold harmless Fluyenta and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Services, your violation of these Terms, or your violation of any rights of a third party.

11. Termination

Either party may terminate this agreement at any time. We may suspend or terminate your access to the Services immediately if you violate these Terms. Upon termination, your right to use the Services ceases immediately. We will make your data available for export for 30 days following termination, after which it may be deleted.

12. Governing Law

These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising under these Terms shall be resolved through good-faith negotiation first, and if unresolved, through binding arbitration or the courts of competent jurisdiction.

13. Changes to These Terms

We may update these Terms from time to time.
